Litigation funding is becoming more common these days. Most legal consumers cannot afford the attorney's standard rate or the costs of preparing a lawsuit for trial. When a third party agrees to pay a client's legal fees or costs, tensions can arise between the lawyer's duty to the client and the third-party payer's expectations. Join this webinar to address some of the ethical questions that can arise in non-insurance, third-party payer situations. Provide practical guidance to the attorney confronted with such a situation and to suggest how the attorney can comply with his or her ethical responsibilities.  

 Objectives 

  • Describe the history of litigation funding
  • Identify the rules of professional conduct that may be implicated including 1.8(f), 1.7, 5.4(c)
  • Determine the ethical concerns an attorney must evaluate when advising a client about a litigation funding transaction  

 CLM Recertification Credit: 1 hour in the subject area of Legal Industry/Business Management (LI) 

CLM App Credit for Functional Specialists: 1 hour in the subject area of Legal Industry/Business Management (LI) towards the additional hours required of some Functional Specialists to fulfill the CLM application

Chris Little, JD, is a 25 year lawyer with Montgomery Little & Soran, P.C. celebrating its 50th year of practice. Little routinely lectures and publishes in the area of lawyer-s professional liability. Among numerous bar duties, he has served on the ABA LPL committee, the Colorado Bar Association's LPL committee and the DRI professional liability committee. He is a former president of the Colorado Defense Lawyer's Association, the Denver Bar Association and has served as a member in the ABA House of Delegates.
